1. Acceptance of Terms

By accessing or using the unimark platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an institution, you represent that you have the authority to bind that institution to these Terms.

If you do not agree with any part of these Terms, you may not access or use the Service.

2. Description of Service

unimark provides a digital attendance management platform for educational institutions, including but not limited to:

• Automated attendance tracking via local network verification
• Faculty dashboard for session management and reporting
• Student dashboard for attendance monitoring and academic resources
• Administrative analytics and reporting tools
• Assignment and notes management features

3. User Accounts

Account Creation

Accounts are typically provisioned by your institution's administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Account Responsibilities

• You must provide accurate and complete information during registration
• You must not share your account credentials with others
• You must immediately notify us of any unauthorized use of your account
• You are responsible for all activity conducted through your account

4. Acceptable Use

You agree not to use the Service to:

• Attempt to falsify or manipulate attendance records (proxy attendance)
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code from the Service
• Upload malicious content, viruses, or harmful code
• Harass, abuse, or harm other users of the platform
• Violate any applicable laws or institutional policies
• Access data belonging to other users without authorization

Violations of acceptable use may result in immediate account suspension or termination.

5. Institutional Licensing

Institutional access to unimark is governed by separate licensing agreements between unimark and the subscribing institution. These agreements define:

• Number of authorized users
• Feature access levels and modules
• Data retention and processing terms
• Support and service level commitments
• Billing and payment terms

6. Intellectual Property

The unimark platform, including its source code, design, logos, and documentation, is the exclusive property of unimark and its licensors. These Terms do not grant you any rights to use the unimark brand name, trademarks, or logos without prior written consent.

Content uploaded by users (assignments, notes, etc.) remains the intellectual property of the respective user or institution.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices outlined in our Privacy Policy.

8. Service Availability

We strive to maintain 99.9% uptime for the unimark platform. However, we do not guarantee uninterrupted access and may temporarily suspend the Service for:

• Scheduled maintenance (with prior notice)
• Emergency security patches
• Force majeure events beyond our reasonable control

9. Limitation of Liability

To the maximum extent permitted by law, unimark and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount paid by your institution in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the platform or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
